User Agreement
Plain words, on purpose.
What you're agreeing to
FloodGate provides paid access to supported AI models through one platform and API. These terms form an agreement between you and FloodGate. By creating an account, using the service, or making a purchase, you accept them. If you do not accept them, do not use the service.
How the service works
- You can buy prepaid AI usage credits, one-time plans, or recurring subscription plans made available by FloodGate.
- Each plan shows its price, currency, allowance, duration, reset schedule, limits, purchase type, and whether it renews before you buy.
- AI requests consume credits or plan allowance at model-dependent rates. Current rates and model availability appear in the platform and may change prospectively.
- We may add, replace, limit, or remove models and upstream providers. We do not guarantee that a particular model will remain available.
Platform credits
- Credits are a prepaid, limited right to use supported AI services on FloodGate. They are not money, virtual currency, a cash wallet, or a payment instrument.
- Credits have no cash value outside FloodGate. You cannot withdraw, redeem for cash, transfer to another user, sell, trade, or use them outside the platform.
- Purchased credits expire six months after the purchase date. Unused expired credits do not roll over and are removed from the available balance.
- Promotional or free credits may have separate limits or an earlier expiry date disclosed when granted.
- Credits are consumed according to the model, request type, token usage, media settings, and other pricing factors shown by the platform.
Signup credit offer
- When the offer is active, an eligible GitHub signup receives $20 in credit immediately.
- Another $30 stays locked until successful wallet top-ups reach $5 within the stated qualification period. Smaller top-ups remain available and count toward the total.
- A referred user unlocks an additional $10 at the same time. Their inviter receives $10 in referral credit.
- The wallet shows top-up progress. Pending, failed, canceled, subscription, and redemption-code transactions do not count.
- A refunded top-up is removed from progress. If the remaining total falls below the target, related signup and referral credits may be reversed.
Plans and subscriptions
- A one-time plan is charged once and does not renew automatically. Its allowance expires or resets as shown when you purchase it.
- A recurring subscription renews for the interval shown at purchase until canceled. The payment provider may charge the payment method on file at each renewal.
- You may cancel a Creem subscription through the Creem buyer portal linked from your purchase email or through Creem Buyer Support. Cancellation normally takes effect at the end of the current paid period, and you keep access until then.
- Cancel before the next renewal date to avoid the next charge. Cancellation does not refund the current period except where required by law.
- Unused plan allowance does not roll into a later period unless the plan expressly says it does. The details presented at purchase control.
Your account
- One account per person. Give accurate information.
- Your API keys are secrets. Keep them safe. Usage under your key is your usage.
- Tell us right away if a key leaks. We'll revoke it.
Payments
- Before payment, we show what you are buying, the credits or allowance received, the amount and currency charged, and whether the purchase is one-time or recurring.
- Taxes may be calculated at checkout where applicable.
- For purchases processed by Creem only, our order process is conducted by our authorized online reseller Creem. Creem is the Merchant of Record for that purchase and handles payment-related buyer support and returns. FloodGate provides and supports the AI service.
- Purchases made through another payment provider are not sold by Creem and are handled under that provider's applicable checkout terms.
Refunds
Credits and subscriptions are non-refundable and all purchases are final, except where required by law. This applies to used and unused credits, partial subscription periods, and unused plan allowance. See our Refund Policy for the process, mandatory consumer rights, and Creem-specific support.
Acceptable use
You must use FloodGate lawfully and responsibly. You must not use the service to:
- break applicable law, violate sanctions, or infringe another person's intellectual property, privacy, or other rights;
- create, request, distribute, or facilitate illegal, exploitative, abusive, threatening, or deliberately harmful material;
- create, request, upload, distribute, or facilitate NSFW, sexually explicit, or sexually suggestive content, including through an AI model or generated output;
- develop or distribute malware, phishing, spam, credential theft, surveillance, or instructions for unauthorized access;
- attack, probe, overload, disrupt, reverse engineer, or bypass security, rate limits, access controls, or provider safeguards;
- misrepresent your identity, deceive people unlawfully, or use outputs for prohibited automated decisions; or
- share, sublicense, or resell your account, API keys, credits, or service access without our written permission.
Restriction and termination
We may throttle, restrict, suspend, or terminate access if we reasonably believe an account has violated these terms, an upstream provider's rules, or the law, or presents a security, fraud, abuse, or harm risk. We may act without notice where urgent action is needed. Termination stops API keys and service access. Remaining credits or allowance may be forfeited where the law permits. Mandatory consumer rights still apply.
Third-party AI providers
FloodGate routes requests to supported third-party AI providers. Their availability, safety controls, model behavior, and terms may affect the service. You are responsible for using each model lawfully and for checking whether its output is suitable for your purpose.
Model outputs
AI models can be wrong, biased, or outdated. Outputs are not professional, legal, medical, or financial advice. Check anything that matters. We don't guarantee any specific output.
Availability
Models, providers, and network routes can change, pause, or fail. We do not promise uninterrupted availability or a particular model response. If a paid service is not delivered, any remedy or refund required by law remains available.
Consumer rights
Nothing in these terms excludes or limits rights that applicable consumer law does not allow us to exclude. If local law gives you a mandatory withdrawal, cancellation, refund, repair, replacement, or other remedy, that right prevails over conflicting language in these terms.
Changes to these terms
We may update these terms. The current version always lives on this page. If a change is significant, we'll announce it. Continuing to use Floodgate after a change means you accept it.
Liability
The service is provided "as is". To the fullest extent the law allows, Floodgate is not liable for indirect or consequential damages. Our total liability is capped at what you paid us in the 12 months before the claim.
